Terms of Service — CarsMMO Private Alpha

1. Who offers this

CarsMMO is a video game under development offered by Iñigo Rodriguez-Rovira (the "developer"), based in Madrid, Spain. Contact: hola@carsmmo.com.

2. What the alpha is (and is not)

CarsMMO is in private alpha: a version under construction, incomplete and with bugs, offered for free to a limited group of invited testers for the sole purpose of testing and improving the game. It is not a finished product nor a commercial service.

Accordingly:

• The service may be interrupted, changed or shut down at any time, temporarily or permanently, without notice and without compensation.
• Game progress (accounts, cars, parts, credits, records) may be wiped in whole or in part whenever development requires it. Nothing you achieve in the alpha constitutes a right or has economic value.
• Mechanics, balance and content will change constantly.

3. Your account

• Playing requires an account, and creating one requires an invite code whenever the gate demands it.
• One person, one account, one pilot. Creating multiple accounts or sharing an account may lead to the suspension of all accounts involved.
• You are responsible for keeping your password safe. Do not reuse a password from other services.
• The alpha is intended for adults. If you are a minor, you need permission from your parent or legal guardian.

4. Code of conduct

• Play fair. Cheating, automation, tampering with the client or its network traffic, or abusing game bugs for your own benefit may lead to the immediate suspension or deletion of your account.
• Behave: no harassment, insults, impersonation or illegal content in chat or in names.
• The developer may suspend accounts and remove testers from the alpha at his discretion, with or without notice, when necessary to protect the service or other players. During the alpha there is no formal appeal process, though you may always write to hola@carsmmo.com.

5. License and intellectual property

• You are granted a personal, free, non-exclusive, revocable and non-transferable license to install and use the launcher and the game for the sole purpose of participating in the alpha.
• All game content (code, art, the brands and names of the Carland universe, music, texts) belongs to the developer or his licensors. The license does not transfer any rights over them.
• Decompiling, modifying or redistributing the game is not allowed, except as expressly permitted by law.

6. No warranties

The game and the service are provided "AS IS" and "AS AVAILABLE", without warranties of any kind: of operation, of absence of errors, of progress preservation, or of server availability. You install and play at your own risk.

7. Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for indirect damages, loss of data unrelated to the game, loss of profit, or damages arising from the use or inability to use the alpha. As this is a free service, the developer's total liability shall in any case be limited to the amount you paid for it: zero euros.

Nothing above excludes or limits liability that cannot legally be excluded (in particular, liability arising from willful misconduct or gross negligence, or non-waivable rights granted to you by consumer law).

8. Personal data

The processing of your data is governed by the Privacy Policy, which forms part of these terms.

9. Changes

These terms may change as the game evolves. Relevant changes will be announced on carsmmo.com and the current version will always be published there. Continuing to play after a change means you accept it.

10. Governing law

These terms are governed by Spanish law. Any dispute shall be submitted to the courts of Madrid (Spain), unless consumer regulations establish another non-waivable forum, in which case that forum shall apply.
